These Terms & Conditions (“Terms”) govern your access to and use of the website https://rudrajewels.in (“Site”) operated by Rudra Jewellers (“we”, “us”, “our”). By accessing the Site or placing an order, you (“you”, “user”, “customer”) agree to be bound by these Terms.
If you do not agree, please do not use the Site.
1. Definitions
– “Site” refers to https://rudrajewels.in.
– “Products” refers to gold jewellery and related items listed for sale on the Site.
– “Order” refers to a confirmed purchase request placed by the customer.
– “Customer” / “User” refers to any individual accessing or transacting on the Site.
– “BIS” refers to the Bureau of Indian Standards.
– “HUID” refers to the Hallmark Unique Identification number.
2. Eligibility
To place an order on the Site, you must:
– Be at least 18 years of age.
– Be legally competent to enter into a contract under the Indian Contract Act, 1872.
– Provide accurate, complete, and current information.
– Use the Site only for lawful purposes.
We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.
3. Account Registration
You may browse the Site without an account. To place an order, you may need to register. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorised use.
4. Product Information
We make reasonable efforts to display product details, weight, karat, making charges, and images accurately. However:
– Actual product colour, finish, and shade may vary slightly from the images due to lighting, photography, and screen calibration differences.
– Weight tolerance: Actual weight may vary by ±0.1 grams from the listed weight, due to manufacturing variance.
– All gold products are BIS-hallmarked ensuring stated purity (e.g., 14K = 58.3% gold).
5. Pricing
All prices are listed in Indian Rupees (₹) and inclusive of applicable taxes unless stated otherwise.
– Product price = (Prevailing gold rate × weight) + Making charges + Wastage + GST.
– Gold rates are revised daily based on market price.
– The price displayed at the time of order placement is the binding price.
– We reserve the right to correct any pricing errors before order confirmation. If a pricing error is detected after order placement, we will contact you for revised confirmation or full refund.
6. Order Placement & Acceptance
– An order is considered placed only upon successful payment confirmation.
– We reserve the right to accept, reject, or cancel any order at our discretion, including but not limited to: stock unavailability, suspected fraud, pricing errors, customer verification failures, or shipping restrictions.
– An order confirmation email does not constitute acceptance; acceptance occurs only upon dispatch.
– For high-value orders (₹2,00,000 and above), additional KYC verification (PAN, identity proof) is mandatory under Section 269ST of the Income Tax Act, 1961.
7. Payment
– Payment must be completed in full before dispatch.
– Accepted modes: as displayed on the checkout page.
– All online payments are processed via PCI-DSS compliant payment gateways.
– We do not store credit/debit card or bank account details.
– For Cash on Delivery (where available): payment in cash to the courier at the time of delivery.
8. Shipping & Delivery
Shipping is governed by our separate Shipping Policy, which forms part of these Terms.
9. Returns, Refunds & Exchange
Returns, refunds, and exchanges are governed by our separate Return & Return Policy, which forms part of these Terms.
10. Intellectual Property
All content on the Site — including but not limited to logos, brand names, product names, designs, images, descriptions, text, graphics, and software — is the property of Rudra Jewellers or its licensors and is protected by Indian and international intellectual property laws.
You may not copy, reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent. Unauthorised use may result in legal action.
11. User Conduct
You agree NOT to:
– Use the Site for any unlawful, fraudulent, or harmful purpose.
– Attempt to gain unauthorised access to any part of the Site, servers, or databases.
– Upload viruses, malware, or harmful code.
– Engage in price manipulation, fake orders, or chargeback fraud.
– Impersonate any person or entity.
– Harvest data, scrape content, or use automated tools without permission.
– Resell our products commercially without written authorisation.
Violations may result in account termination, order cancellation, and legal proceedings.
12. Disclaimer of Warranties
The Site and all products are provided on an “as is” and “as available” basis. We make no warranties, express or implied, except BIS Hallmark Guarantee. All gold products are certified for the stated purity by BIS-recognised assaying and hallmarking centres.
Beyond these specific guarantees, we disclaim all other warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
13. Limitation of Liability
To the maximum extent permitted by law:
– Our total liability for any claim shall not exceed the amount paid by you for the specific order in question.
– We are not liable for indirect, incidental, consequential, punitive, or special damages.
– We are not liable for delays, failures, or damages caused by events beyond our reasonable control (see Force Majeure).
– Nothing in this clause limits liability for fraud, wilful misconduct, or any liability that cannot be limited under Indian law.
14. Force Majeure
We shall not be held liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to: natural disasters, pandemics, government actions, strikes, riots, war, terrorism, cyber-attacks, courier service disruptions, or supplier failures.
15. Indemnity
You agree to indemnify and hold Rudra Jewellers, its proprietor, employees, agents, and partners harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:
– Your breach of these Terms.
– Your violation of any law or third-party rights.
– Your misuse of the Site or products.
16. Termination
We may suspend or terminate your access to the Site at our sole discretion, with or without notice, for any reason including violation of these Terms. Termination does not affect your obligation to pay for orders placed prior to termination.
17. Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated via the Site or registered email. Continued use of the Site after such updates constitutes acceptance of the revised Terms.
18. Privacy
Use of your personal data is governed by our Privacy Policy, which forms part of these Terms.
19. Governing Law and Jurisdiction
These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the use of the Site shall be subject to the exclusive jurisdiction of the courts at Alwar, Rajasthan.
20. Dispute Resolution
Before initiating legal proceedings, both parties agree to first attempt resolution through good-faith negotiation. If unresolved within 30 days, disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration at Alwar, Rajasthan.
21. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
22. Entire Agreement
These Terms, together with the Privacy Policy, Shipping Policy, Refund & Return Policy, and BIS Hallmark Policy, constitute the entire agreement between you and Rudra Jewellers regarding the use of the Site. By placing an order on our website, you acknowledge and accept these Terms & Conditions.
